This is what you often get as a crime victim in America-- the justice system only torments you further. No matter HOW MUCH you try to remind the suckass criminal justice system of your dead relative's LIFE, which was brutally taken away from them, there is always another side....
and THAT side pulls out every stop.

LITTLE ROCK — The daughter and sister of a De Queen woman who was beaten, strangled and stabbed in her apartment in 1993 cried Monday as they asked the state Parole Board not to recommend clemency for a death-row inmate convicted in the slaying.
Stacey Eugene Johnson, 40, is scheduled to die by injection May 4 for the slaying of Carol Heath. He has asked the Parole Board to recommend that Gov. Mike Beebe grant him executive clemency, claiming he is innocent.
Stacey Johnson does not deserve clemency for taking my sister away from not just me and my mom and my dad but from her children,” said Heath’s sister, Melissa Cassady, at a victim input hearing at the Parole Board’s headquarters in Little Rock.
Heath’s daughter, Ashley Heath, who was 6 years old when her mother was killed and was in the apartment at the time, appeared at the hearing but was too upset to read her prepared statement. Assistant Attorney General Lauren Heil read the statement, in which Heath said she has been in counseling for much of her life because of what she witnessed on the night of the slaying.
“No 6-year-old child should have to see a parent dying in a pool of blood,” she said in the statement.
Carol Health’s 2-year-old son also was home at the time of the slaying.
Earlier Monday, the board met at the state Department of Correction’s Varner Super Max Unit to hear Johnson’s arguments for clemency.
In a statement accompanying Johnson’s application for clemency, his attorney, Jeff Rosenzweig of Little Rock, claimed there is reasonable doubt of Johnson’s guilt.
Rosenzweig said jurors were not allowed to see evidence that Ashley Heath was coached to identify Johnson; that DNA testing would exonerate Johnson if evidence were retested with updated technology; that Johnson was prohibited from presenting evidence about another possible suspect; that statements made by Johnson to police were admitted as evidence even though a recording of the statements “was mysteriously lost”; and that Johnson, who is black, was tried by a jury that was almost all white.
“There is more than reasonable doubt as to his guilt. It would be tragic if he were executed under these circumstances,” Rosenzweig said in the statement.
Prosecutor Bryan Chesshir told the board at the hearing in Little Rock that Johnson and Rosenzweig raised no arguments that had not already been raised and rejected in Johnson’s appeals.
Johnson was first tried and convicted in 1994, but the state Supreme Court overturned that conviction because of improper hearsay evidence. Johnson was tried again and convicted in 1997, and the state Supreme Court has upheld that conviction.
Chesshir said physical evidence linking Johnson to the crime has been retested at least three times. A discarded shirt found in a highway rest stop had blood on it that matched the victim’s blood, and a cigarette butt found in a pocket of the shirt had saliva on it that matched Johnson’s DNA so closely that the possibility of it coming from anyone else was 1 in 720 million, he said.
“If you take away everything else except the DNA, I truly believe you have the same sentence,” he said.
The board was expected to announce a recommendation today. Beebe will not be bound by the recommendation.
